These Terms of Service (the “Terms”) explain the rules that apply when you visit lumoryn.com (the “Site”), create an account or purchase from LUMORYN. The Site is operated by Mavora International Limited, trading as LUMORYN (“LUMORYN,” “we,” “us” or “our”).

Please read these Terms before using the Site or placing an order. By using the Site or submitting an order, you agree to these Terms. If you do not agree, please do not use the Site. Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded or limited in your country or region.

Our Privacy Policy, Shipping & Delivery Policy, Return & Refund Policy and any product-specific or promotional terms referred to at checkout also form part of your agreement with us where applicable.

1. Who May Use the Site

You must be legally capable of entering into a binding contract in your place of residence. If you are under the applicable age of majority, you may use the Site only with the involvement and permission of a parent or legal guardian.

If you use the Site on behalf of a company or another person, you confirm that you have authority to bind them to these Terms.

2. Product Information

We take reasonable care to describe and photograph our jewelry accurately. Screen settings, lighting and photography can affect how colors and finishes appear, and measurements and weights may vary slightly.

Natural pearls, shells, stones and other natural or handcrafted elements can differ in color, pattern, shape, texture and surface character. These individual variations are part of the material and are not defects. Material variations do not excuse a product that is damaged, faulty or materially different from its description.

Product availability may change without notice. Placing an item in your cart does not reserve it. We may limit quantities where reasonably necessary, including to protect product availability, prevent fraud or restrict purchases that appear intended for unauthorized resale.

3. Prices, Currency and Payment

Prices are shown in the currency selected or displayed on the Site. If your payment method uses a different currency, your bank or payment provider may apply its own exchange rate or fees. These charges are controlled by that provider, not LUMORYN.

The amount payable is the amount shown at checkout, including any taxes or shipping charges that we are required and able to collect. Unless checkout expressly states that import duties, customs charges or local import taxes are included or prepaid, those amounts are the customer’s responsibility. Customs authorities or delivery providers may collect them before or upon delivery.

Payment is processed through Shopify and the payment methods offered at checkout. You confirm that you are authorized to use the payment method and that the billing information you provide is accurate. We may use lawful fraud-prevention and payment-verification measures before accepting or dispatching an order.

Although we take reasonable care, pricing or product-information errors can occur. If an obvious error affects your order, we will contact you before dispatch and offer you the choice to proceed on the corrected terms or cancel for a full refund. We will not charge a higher price without your agreement.

4. Placing and Accepting Orders

Submitting an order is an offer to purchase the products in your cart. The automatic order acknowledgement confirms that we received your order; it does not by itself mean that we have accepted it.

Your order is accepted, and a sales contract is formed, when we send confirmation that the order has been dispatched, unless applicable law provides otherwise. We may decline or cancel an order before acceptance for a legitimate reason, including unavailable stock, an obvious pricing or description error, suspected fraud, payment failure, delivery restrictions or inability to verify information needed to complete the order.

If payment has already been taken for an order that we do not accept, we will refund the amount paid to the original payment method. Your bank or payment provider may require additional time to display the refund.

5. Order Changes and Cancellations

Check your order and delivery details carefully before submitting it. If you need to request a change or cancellation, email support@lumoryn.com within 12 hours of placing the order.

We will honor a cancellation request received within that period if the order has not already entered processing or been dispatched. Because orders can move into processing quickly, a change or cancellation cannot be guaranteed once preparation has begun. If cancellation is no longer possible, you may request a return after delivery in accordance with our Return & Refund Policy.

This section does not limit any statutory cancellation or withdrawal right available to you under applicable consumer law.

6. Shipping and Delivery

We ship to the destinations made available at checkout. Complimentary standard shipping is currently offered to all destinations available for purchase through the Site. Any additional or alternative delivery service and its charge will be displayed before you submit the order. Available services and delivery estimates may depend on the destination.

Delivery times are estimates, not guaranteed dates, unless we expressly agree otherwise. Customs processing, carrier disruption, weather, public holidays and other events outside our reasonable control can cause delays. We will provide available tracking information after dispatch and will take reasonable steps to assist if a parcel is materially delayed, lost or damaged in transit.

You are responsible for providing a complete and accurate delivery address and contact information. Contact us promptly if you notice an error. We cannot guarantee that an address can be changed after processing begins. Additional delivery costs reasonably caused by an incorrect or incomplete address may be charged to you where permitted by law and clearly communicated.

Risk of loss or damage passes to you when the order is delivered to you or to a person you identify to receive it, except where applicable law provides otherwise. If you independently appoint a carrier that we did not offer, risk may pass when the order is handed to that carrier, to the extent permitted by law.

7. Returns, Exchanges and Refunds

Eligible items may be returned within 30 days of receipt in accordance with our Return & Refund Policy. For a voluntary change-of-mind return, the item must be unworn, unused and in its original condition, with its original packaging and accessories. Where a LUMORYN Return Tag or Security Seal is supplied, it must remain attached, intact and unaltered.

Customers generally pay the return-shipping cost for change-of-mind returns. If an item is faulty, damaged on arrival or incorrect, contact us promptly; where the claim is valid, LUMORYN will provide an appropriate remedy and cover reasonable return costs as required by applicable law.

Approved refunds are issued to the original payment method, normally within 5–7 business days after inspection. Banks and payment providers may require additional processing time. Exchanges are subject to availability and are generally offered for the same product in another available variant; otherwise, a return and new order may be required.

Items marked Final Sale are not eligible for voluntary change-of-mind returns where this is clearly disclosed before purchase. This does not remove rights relating to faulty, misdescribed or otherwise non-conforming goods.

8. Limited Commercial Warranty

LUMORYN provides a six-month limited commercial warranty from the date of delivery for eligible defects in materials or workmanship. This voluntary warranty does not cover normal wear, accidental damage, misuse, improper storage, exposure to chemicals or moisture contrary to care instructions, tarnishing or gradual plating wear, unauthorized modification, loss or theft, or the natural variations described in Section 2.

We may request photographs and reasonable proof of purchase to assess a claim. Depending on the circumstances and availability, an eligible claim may result in repair, replacement or another appropriate remedy.

This commercial warranty is additional to, and does not replace or restrict, any statutory rights or legal guarantees that apply to your purchase. In some jurisdictions, those rights may last longer than six months.

9. Promotions and Discount Codes

Promotions and discount codes are subject to the conditions displayed with the relevant offer, including any dates, product exclusions or minimum-spend requirements. Unless stated otherwise, offers cannot be combined, exchanged for cash or applied retrospectively to completed orders.

We may withdraw or correct a promotion where there is an obvious error, fraud, misuse or a technical problem, but we will not retroactively alter a promotion already validly applied to an accepted order unless required by law.

10. Customer Accounts

You may be able to shop as a guest or create a customer account. You are responsible for keeping your sign-in details confidential and for providing current and accurate information. Tell us promptly if you believe your account has been accessed without authorization.

We may suspend or restrict an account where reasonably necessary to protect customers, investigate fraud, address unlawful activity or respond to a serious breach of these Terms. We will not use this right to avoid fulfilling an accepted order or a legal obligation.

11. Acceptable Use

You must not use the Site to:

• break the law or infringe another person’s rights;
• submit false, fraudulent or misleading orders or information;
• introduce malicious code or interfere with the Site’s security or operation;
• scrape, copy or extract Site content through automated means for commercial use without our permission; or
• attempt to gain unauthorized access to accounts, systems or data.

We may take proportionate steps to prevent or stop prohibited use, including restricting access or cancelling fraudulent orders, subject to applicable law.

12. Intellectual Property

The Site and its content—including the LUMORYN name, logos, product names, photographs, graphics, designs, text, layout and software—are owned by or licensed to LUMORYN and are protected by applicable intellectual-property laws.

You may view and use the Site for personal, non-commercial shopping purposes. You may not reproduce, modify, distribute, sell, license or commercially exploit Site content without prior written permission, except where the law expressly permits it.

13. Third-Party Services and Links

The Site uses services provided by Shopify and may contain links to payment providers, delivery providers, social platforms or other third parties. Those parties may apply their own terms and privacy notices to services they independently provide.

We are not responsible for an external website merely because the Site links to it. This does not affect our responsibility for providers acting on our behalf or for obligations that applicable law places on us as the seller.

14. Privacy and Cookies

Our Privacy Policy explains how we collect, use and share personal information and how you can exercise applicable privacy rights. Our cookie controls explain the choices available for non-essential cookies and similar technologies.

By agreeing to these Terms, you do not automatically consent to optional marketing, analytics or advertising technologies. Where consent is required, it will be requested separately.

15. Our Responsibility to You

We do not exclude or limit liability where doing so would be unlawful. This includes liability that cannot be excluded for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, and mandatory consumer rights and remedies.

We are responsible for losses that are a reasonably foreseeable result of our breach of these Terms or failure to use reasonable care. We are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses where you purchased solely as a consumer.

The Site may occasionally be unavailable for maintenance, security or reasons outside our reasonable control. We do not guarantee uninterrupted access, but this does not affect obligations relating to an accepted order.

Nothing in this section reduces any right you may have under applicable consumer law, including rights concerning products that are faulty, unsafe, misdescribed or not of acceptable quality.

16. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by an event outside our reasonable control, such as severe weather, natural disaster, epidemic, war, civil disturbance, government action, customs disruption, carrier interruption, labor dispute or major systems failure.

We will take reasonable steps to reduce the effect of the event and resume performance. If it causes a substantial delay, we will provide any cancellation or refund rights required by law and, where reasonably possible, offer an appropriate way to end the affected order.

17. Changes to These Terms

We may update these Terms to reflect changes in our services, operations or legal obligations. The “Last updated” date identifies the current version.

The Terms in effect when you place an order will normally govern that order. We will not retroactively make a material change that disadvantages you in relation to an already accepted order, unless the change is required by law or you agree to it.

18. Governing Law and Disputes

These Terms and any non-contractual dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-laws rules.

This choice of law does not deprive you of mandatory consumer protections available under the law of your country or region of residence. Nothing in these Terms prevents you from bringing a claim in a court or using a dispute-resolution process available to you where applicable consumer law gives you that right. The courts of Hong Kong have non-exclusive jurisdiction over disputes arising from these Terms.

Before starting formal proceedings, we encourage you to contact us so we can try to resolve the issue directly. This does not prevent either party from seeking urgent relief or exercising a right within an applicable time limit.

19. General Provisions

If a court or competent authority finds part of these Terms unlawful or unenforceable, that part will be applied to the greatest extent permitted or removed, and the remaining provisions will continue in effect.

If we do not enforce a provision immediately, that does not waive our right to enforce it later. A waiver is effective only if it is given in writing.

We may transfer our rights and obligations under these Terms as part of a genuine business reorganization, sale or transfer, provided this does not reduce your rights or protections. These Terms do not give enforcement rights to any third party except where applicable law provides otherwise.
